Simptech Corp. ("we") sets out below how we handle users' personal information. This policy explains what personal information we collect, how we use and share it, and how users can manage their own information.

2. How we collect personal information

When you send us an enquiry or a comment, we collect your company name, name, telephone number and email address, together with what you send us (the subject, the message and the names of any attached files). When you use the contact form, we also collect the IP address it was sent from, the country determined from that IP address, and your browser information (User-Agent). Personal information collected within any individual service is governed by the terms of that service.

3. What we use it for

We use the information we collect to reply to your enquiry, for business purposes, and to prevent unwanted or improper submissions. The purposes for any individual service are governed by the terms of that service.

Information collected through the contact form is stored on the cloud services we use. We have not set a retention period. If you would like it deleted, please ask using the method in section 7.

We may entrust part of the handling of personal information to outside providers of cloud and email-sending services. Entrustment to providers located outside Japan is described under "Provision to third parties in a foreign country (entrustment)" below.

Provision to third parties in a foreign country (entrustment)
We entrust the handling of personal information sent through the contact form to the providers in the United States of America (US) listed below. Because this entrustment is a provision of personal data to third parties in a foreign country, when you send the contact form we ask you to read this section and to consent to the provision of your personal data to these US providers.

Providers and the information provided
- Cloudflare, Inc. (US): provider of the cloud services we use to deliver our website, receive the contact form and store what is sent. We provide all of the information collected through the contact form described in section 2, including any attached files.
- Plus Five Five, Inc. (US; service name: Resend): provider of the email-sending service that delivers what is sent to our inbox. We provide your company name, name, telephone number, email address, the content of your enquiry and any attached files.

The US system for protecting personal information
The US has no comprehensive federal law on the protection of personal information; instead, there are laws for particular sectors such as healthcare, finance and electronic communications. California, where both providers have their headquarters, has a comprehensive law, the California Consumer Privacy Act (CCPA), which applies to businesses that meet certain conditions such as size. According to the survey by Japan's Personal Information Protection Commission (PPC), the CCPA has no provision corresponding to the Accountability Principle among the eight principles of the OECD Privacy Guidelines.
The US has participated in the APEC Cross-Border Privacy Rules (CBPR) System since 25 July 2012. The PPC states that, for the private sector in economies participating in the CBPR System, protection of personal information broadly equivalent to Japan's can be expected.
The PPC's survey (as of October 2021) does not identify any system in the US (federal or California) that requires personal information to be stored within the country, or that obliges businesses to cooperate with government information-gathering, in a way that could significantly affect individuals' rights and interests.

Measures taken by the providers to protect personal information
We have data processing agreements with both providers covering their handling of personal data. Under these agreements, both providers undertake to handle personal data only for the purposes set out in the agreement and on our instructions; to place the people who handle it under a duty of confidentiality; to take security measures; to notify us without undue delay of a breach; to notify us before adding or replacing a sub-processor; to assist us in responding to requests from individuals, such as requests for disclosure or deletion; and to delete or return the personal data when the service ends.
Cloudflare, Inc. holds third-party certifications including ISO/IEC 27001 and SOC 2 Type II, and is certified under the Global CBPR and Global PRP systems. Plus Five Five, Inc. states that it is SOC 2 Type II compliant.
As far as we have checked the agreements and the providers' published materials, we have found no measure that Japan's Act on the Protection of Personal Information requires of a party entrusted with handling personal data that these providers do not take.

4. How we keep personal data safe

We work to keep personal information accurate and up to date, and we train all employees and officers in order to protect it from unauthorised access, alteration, leakage, loss and damage. We also maintain internal rules for the protection of personal information and check how they are applied in practice on a regular basis.

5. Joint use of personal data

We do not make personal data available for joint use. Joint use within any individual service is governed by the terms of that service.

6. Providing personal data to third parties

Except where laws or guidelines provide otherwise, we do not provide personal information to third parties without consent.

7. Disclosure and correction of retained personal data

Where a person asks us to disclose their personal information, we will disclose it to them without delay. If you wish to be told the purpose of use, or to have your information corrected, added to, deleted, its use stopped, or its provision to third parties stopped, please email us as follows.

9. SSL

Our website supports SSL and encrypts communication between the web browser and the web server. Personal information such as the name and telephone number you enter is encrypted automatically.

10. Cookies

A cookie is data sent from a web server to a web browser. By reading cookies, a web server can recognise your computer, which lets you use our website more efficiently. The files our website sends as cookies do not contain information that identifies an individual. You can disable cookies in your browser settings.

We take care over the accuracy of the information published on our website, but we accept no liability for anything a user does on the basis of that information. We accept no liability for loss suffered by a user as a result of using our website, or for loss a user causes to a third party.
